From 1 July 2026, Signature Property Agents is a reporting entity for designated services under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and the AML/CTF Rules.
This means that when we provide designated services under the AML/CTF Act, we are required by law to identify and verify our customers and comply with other obligations under the Act.
We handle the personal information we collect for these purposes in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
To meet our legal obligations, we collect and verify identity information about our customers and, in some cases, the individuals who ultimately own or control a company, trust or other legal entity.
This information usually includes your full name, date of birth and residential address, together with details from a current identity document, such as the document type, number and expiry date.
Depending on the circumstances, we may also ask for information about the source of funds, source of wealth, or the purpose and nature of the transaction where required to meet our legal obligations. We may also request additional information or documentation where required to meet our legal obligations or where enhanced customer due diligence is necessary.
We may also be required by law to report certain transactions or suspicious activities to AUSTRAC.
We collect this information to:
- Confirm your identity;
- Understand the nature of the property transaction;
- Assess the risk of money laundering or terrorism financing; and
- Caarry out the ongoing customer due diligence required during our business relationship with you.
If you do not provide the information we require, we may be unable to act for you or complete the transaction.
We may disclose your personal information to AUSTRAC where required by law, and to the identity verification provider we use to confirm your identity. We use AplyID to conduct identity verification on our behalf. Information collected through AplyID is handled in accordance with its privacy and security practices. Information is stored in Australia and is not transferred overseas.
We take reasonable steps to keep your information secure and have procedures in place to respond promptly if a data breach occurs.
Where possible, we avoid retaining full copies of identity documents. Where a copy is collected, we retain it only where reasonably necessary and take reasonable steps to securely destroy or de-identify it once it is no longer required. Instead, we generally record only the information required to meet our legal obligations, such as your name, date of birth, residential address, document type, document number, expiry date, the verification method used and the outcome of the verification.
We retain the records we are required to keep for seven years after the end of our business relationship with you, or your last transaction with us, as required by the AML/CTF Act.
Our AML/CTF obligations apply to sellers and other customers where we provide designated services under the AML/CTF Act. We appreciate your cooperation in helping us meet these legal requirements.
You may request access to, or correction of, the personal information we hold about you. Further information about how we collect, use and disclose personal information is available in our Privacy Policy.
